A. Statement of Intent
The City of Fishers, Hamilton County, Indiana, an Indiana municipality duly organized
pursuant to the laws of the State of Indiana (“City”), issues this Request for Proposals and
Qualifications (“RFPQ”) to prospective entities (“Offerors”) interested in submitting a proposal
to build, operate and transfer, a portion of the City’s Nickel Plate Trail in downtown Fishers
from South Street to North Street along the Nickel Plate railroad corridor, including a tunnel
under 116th Street and other associated improvements as further defined herein (the “Project”),
including, without limitation, the following:
1. preconstruction phase services, including oversight and advice during
preconstruction of the Project;
2. consultation, collaboration, project construction management and other related
services as more fully described in this RFPQ;
3. development of a construction schedule, construction budget, and analysis of
subcontractor qualifications; and
4. guarantees regarding the (i) cost of the Project; and (ii) Project schedule.
After a limited period of operation, the Project will be performed and transferred to the
City pursuant to a public-private agreement (as more fully defined in Section II(B), the “BOT
Agreement”) between the City and the wining Offeror (the “Developer”) in accordance with Ind.
Code § 5-23 et. seq. (the “Act”).

B. General Objectives
The City seeks private involvement to develop and construct the Project, because (1) the
City lacks expertise executing, streamlining, and overseeing specialized development like the
Project; (2) private sector expertise in the design, development, and construction of the Project
will allow the Project to be completed quicker and more efficiently; (3) private sector expertise
will help shift risk away from the City and allow subcontractors to be directly accountable to the
Developer; (4) private sector expertise should prevent unknown costs from being added to the
Project; and (5) the City desires an aggressive delivery of the Project, that is more likely achieved
by the private sector.
