Agricultural/Estate Residential Opt In Program
The agricultural use zoning text amendment revised the Agriculture (AG) and Estate Residential (ER) Zoning District standards, as well as home occupation, accessory structure, and farm animal standards of the Town's zoning code known as the Unified Development Ordinance (UDO). These changes were in direct response to concerns voiced by residents. These changes are applicable to any property of at least 5 acres; however, a rezone of your property to the ER or AG Zoning District is required in order to take advantage.
Property owners who would most likely benefit from these changes would be property owners who would like to add larger accessory structures to their property or would like to have less restrictive home occupation standards. In addition, property owners who currently do not have any existing agricultural operations on their property, but would like that opportunity may also see some benefit to rezoning.
Property owners who currently have an existing agricultural operation will not be affected by these changes. However, we are enacting a process to record and track existing agricultural operations in Fall Creek and Delaware Township in order to identify those existing uses and provide assurance to both the Town and property owners that their uses are noted as legal uses existing prior to the changes in the UDO.
