2018 Fishers Farmers Market Vendor Application

  1. The Fishers Farmers' Market welcomes your application to be a vendor at the 2018 summer market! Our mission is to provide a venue where local farmers, producers, and food inspired companies to come together to offer a variety of fresh local produce, plants and locally crafted food and food-inspired products directly to the Fishers community. Only Indiana grown or produced agricultural products may be sold at the Fishers Farmers' Market. Booth spaces are 10ft. x 10ft. NO CRAFT ITEMS ARE PERMITTED. Registration deadline is March 16.

    Items sold at the Market must be Indiana grown, raised, or made food or food-inspired products or garden and vegetable plants. Please list each product you wish to sell at your booth during the market season. Products not listed on this application are not permitted without pre-approval. You may attach your own list or additional sheets as needed.

  17. Insurance Requirement

    Upon approval of application, vendors must supply the City of Fishers Parks and Recreation Department with a certificate of liability insurance in the amount of One Million Dollars general liability. The City of Fishers, One Municipal Drive, Fishers, Indiana, 46037 shall be listed as additional insured. No vendor will be allowed to sell until the City of Fishers receives a copy of the required insurance. Please indicate how we will receive your COL.

  18. Liability Release

    Exhibitor agrees to protect, indemnify, defend save and hold harmless the City of Fishers, its agents, servants, employees and/or representatives, against and from any and all claims, loss(s), cost(s), damages and/or expenses of any kind or nature arising out of or from any act, accident or occurrence in or at the Exhibitor’s space(s) and/or booth(s) and/or elsewhere on facility property and/or grounds, or from the sale of goods and/or services by Exhibitor and/or Exhibitor’s agents, servants, employees and/or representatives, or from any act or omission of Exhibitor, Exhibitor’s agents, servants, employees and/or representatives and/or invitees. All personal property, inventory, equipment and/or other items belonging to Exhibitor and/or Exhibitor’s agents, servants, employees and/or representatives, shall be there at Exhibitor’s sole risk, and the City of Fishers agents, servants, employees and/or representatives, shall not be liable for any loss, theft and/or damage of any kind sustained by Exhibitor and/or Exhibitor’s agents, servants, employees and/or representatives, provided such loss, theft, and/or damage is not the direct and proximate result of intentional or grossly negligent acts or omissions of City of Fisher’s agents, servants, employees and/or representatives. Exhibitor agrees to abide by and at all times be subject to terms and conditions herein, including those terms respecting the submission and/or refunding of deposits together with all rules and regulations set forth by the City of Fishers which the Exhibitor expressly acknowledges, and which are expressly incorporated herein by reference. Failure to abide by any term or condition herein and/or any rule or regulation, or any misrepresentation by Exhibitor of the merchandise described and/or displayed, may subject Exhibitor to the immediate termination, removal of exhibit (at Exhibitor’s sole expense) and/or cancellation of any and all present and/or future reservations, together with the loss of any and/all fee(s) and/or deposit(s) paid to City of Fishers. Exhibitor alone is responsible for all taxes and/or permits in connection with sales made, as well as comprehensive and liability insurance. Exhibitor alone is responsible for compliance with all local, state and/or federal laws respecting his/her/its exhibition, participation and/or sales. This agreement is entered into and shall be governed by the laws of the State of Indiana and Exhibitor EXPRESSLY Agrees that any and all claims, actions, and/or proceedings with respect to this agreement shall be brought in the Courts of Hamilton County, Indiana to which Exhibitor submits to exclusive jurisdiction.

  19. The Fishers Farmers’ Market reserves the right to schedule vendors according to the demand for their product/number of vendors selling the same product/number of spaces available; picking from the vendor’s chosen dates as required. All vendors must be approved before they are admitted to sell at the Fishers Farmers’ Market. Vendors are not selected on a first-come first-served basis. Vendor selection criteria are designed to keep the market fresh, interesting for visitors, and profitable for vendors. The Fishers Farmers’ Market does not offer exclusivity for any vendor, company, brand, or products sold, except for the City of Fishers. By signing below, I acknowledge that I have read, understand, and agree to abide by the provisions set forth in the Fishers Farmers’ Market Vendor Handbook. I understand that acceptance to the market as a vendor and continued market attendance is based on my compliance with the market policies and regulations.
